New US Visa Bill Could Make Life Easier for International Students
International students applying for an F-1 student visa may soon see a major rule change that could make the process easier and fairer. Currently, students must prove they plan to return to their home country after completing their studies in the US. This requirement has caused many visa rejections over the years—even for students who genuinely want to study and later return home.
But now, the DIGNITY Act of 2025, introduced by Congresswoman María Elvira Salazar and Congresswoman Veronica Escobar, along with support from 20 other members of Congress, suggests removing this rule. If passed, the F-1 visa will become a “dual intent” visa, meaning students can enter the US with the possibility of staying in the future if they meet legal requirements.
What Is the Current Rule?
Right now, when applying for an F-1 visa, students must show nonimmigrant intent—which means they must convince the visa officer that they will leave the US after finishing their education. They often have to show proof like property ownership, family ties, or job offers in their home country.
This has led to many unfair rejections, especially when a student is honest but can’t show strong proof. Even if the student plans to return, not having enough evidence can hurt their application.
What Will Change If the New Bill Passes?
If the DIGNITY Act becomes law, students will no longer need to prove intent to return home. Instead, they can have dual intent—they can come to study and possibly explore legal ways to stay afterward, like work visas, without worrying about being denied for that reason.
It’s important to note that this change doesn’t give students automatic rights to stay after finishing their course. Anyone who wants to stay will still have to qualify for other visa types based on their job, skills, or achievements.
Special Attention to STEM and Healthcare PhDs
The bill also aims to support students who earn PhDs in STEM (Science, Technology, Engineering, and Math) or medical fields in the US.
Currently, it can be difficult for these talented graduates to stay and work in the US even though their skills are in high demand. The bill proposes that people with PhDs in STEM or healthcare be allowed to apply for an O visa, which is meant for individuals with extraordinary ability.
This means talented researchers, scientists, engineers, and doctors can stay in the US and contribute to its development without being forced to leave after graduation.
Other Major Proposals in the Bill
Besides changes to the F-1 visa, the DIGNITY Act includes a few other important suggestions:
Taxing OPT students' earnings: Students working in the US under Optional Practical Training (OPT) might have to pay new taxes on their income under the proposed law.
Fast-track option for green card: Eligible individuals may get the option to “jump the line” for a US green card by paying a fee of $50,000. This is aimed at people who want to stay permanently and meet certain criteria.
What This Means for International Students
This bill, if passed, could bring major relief to international students, especially those who feel nervous about the visa interview process. Many students get rejected just because they fail to “prove” they’ll leave—even if their main goal is just to study.
It also recognizes the value of international talent, especially in STEM and healthcare fields, by creating better pathways to stay and work in the US legally.
